CLARINET GENERAL TERMS AND CONDITIONS
ClariNet offers an electronic publishing service. The service is
offered only under the following terms. Customers who connect their
computers up to the ClariNet network must be aware of these rules.

All members of the ClariNet network must follow the network guidelines
described below. Sites that violate network rules, or allow their
users to violate network rules may be cut off from the Network at
ClariNet's discretion, without warning or refund of subscription fees.
Other steps may also be taken, particularly in cases of copyright
violation or fraud.
An alternate document with guidelines just for users is available. You
must place it in your own system policy area or otherwise make sure
that new ClariNet readers are aware of it. We'll also post it to
clari.net.newusers from time to time. You can also find it on
ftp.clarinet.com in clarinet_info/userterms.
* Customers must promptly pay to ClariNet the appropriate licence
fees for each product the customer licences or subscribes to, on
the stated due dates. In addition, user counts used to calculate
prices must be accurate to the best of the customer's knowledge --
see our user counting guide for details on counting methods.
* Customers must respect the copyright of all copyrighted
information received from ClariNet. Customers must not transmit
ClariNet published information to computers not owned by the
customer without the express consent of ClariNet, or allow anyone
who is not covered by a ClariNet license to access this
information not covered by a ClariNet license. Customers must stop
users of their computer systems who redistribute ClariNet
published information or violate the copyright on ClariNet
publications. Customers must check their own news feeding
mechanisms (sys files, nntp, etc.) for leaks on a periodic basis.
If users of a Customer's system are found to be misappropriating
ClariNet information, this must be reported to ClariNet.
* Some products, notably most features and material from AP and
Reuters, do not allow archiving. Sites must delete material on or
before the specified "Expires:" date and may not keep copies past
that date. Other products allow archiving, but this is subject to
change.
* Customers must provide some control or accounting of the number of
readers on customer's computers for each licenced ClariNet
product. Each Customer must choose a method of counting readers,
or arrange a site or network licence. (Contact ClariNet for
current counting methods.)
* Customers must not interfere with the operation of the ClariNet
network. In particular, customers must not:
1. Post unauthorized netnews "control" messages involving
ClariNet news hierarchies.
2. Post any articles to moderated ClariNet newsgroups.
3. Impersonate ClariNet officials or other persons in postings
within ClariNet news hierarchies.
* These rules are subject to change with 30 days notice by ClariNet
via the "clari.net.admin" newsgroup. Customers unwilling to accept
new rules may obtain a refund of any unused subscription fees.
* Customers must provide reasonable assistance to ClariNet in audits
of customer data, maps and readership figures. Duties include
timely response to reasonable audit requests and other assistance
described in our administrator's manual. The need for this audit
ability is very serious. Customers who do not respond to multiple
audit requests over an extended period may be subject to penalties
such as loss of service.
* In the event that a ClariNet product is canceled before a
subscriber's term of subscription runs out, ClariNet will offer to
transfer the remaining subscription money to other products, or
provide a refund. In the case of a product designated as available
on a "Trial Basis," ClariNet will allow transfer of funds to other
products, but is not required to offer a refund. Note that if your
site subscribes to the full package, the deletion and addition of
minor componenents does not constitute cancellation of that full
package.
* Customers may not re-sell this information in any way, unless
explicitly permitted in writing. Any use of the service to assist
in reporting at a newspaper, radio or tv station, wireservice,
periodical or any other news agency is prohibited. Public access
("BBS") customers are permitted to charge for access to their
systems, but may not make a special charge for ClariNet products
without permission. Schools of journalism must get special
permission before making use of AP material.
* Customers may not edit ClariNet articles or remove attribution
from them.
* The special BBS licence is for public-access, fee-charging dial-up
BBSs only. Corporate BBSs and systems with dedicated full-time
access (other than BBS staff) must pay corporate rates. BBS
operators must make sure that users who access ClariNet news are
aware of those sections of these terms that apply to readers. Any
mentions of ClariNet in promotional material must be sent in
advance to ClariNet (E-mail, fax or paper) for clearance.
* All information from AP, Reuters, Newsbytes, Bay City News and
some other organizations is provided on an "as-is" basis.
General terms and disclaimers of liability
Responsibility for all information transmitted via ClariNet lies with
the poster or information provider. ClariNet makes no warranties,
expressed or implied, concerning the accuracy, sequence, completeness
or fitness for any purpose of any information distributed by ClariNet.
Such warranties may or may not be expressed by information providers.
AP & Reuters make no warranties of any kind regarding the fitness of
their product. Opinions expressed by Information Providers are their
own, and are not necessarily the opinions of Clarinet Communications
Corp. ClariNet makes no warranties regarding the reliability of
network feed points that are not owned and controlled by ClariNet.
Machines not under ClariNet control include the UUNET system, the
UUPSI system and most other intermediate feed sites. ClariNet shall
have no liability for losses of any type due to communications
failures beyond ClariNet's control.
In any event, the liability of ClariNet or any information provider to
any given customer for any and all causes arising from the
availability, use or reliance upon the information, whether for
negligence, network failure, breach of contract or otherwise shall be
limited to the subscription fees prepaid by the customer for the
defined period of troubles. ClariNet or its information providers
shall at no time be liable for consequential damages or lost business
or profits on the part of a customer or related party.
Unless otherwise stated in writing, customers are responsible for the
communications costs involved in transmitting ClariNet products to the
customer's computer system or systems from their ClariNet authorized
feed-point.
